- Agreement Overview
These Terms of Use, along with our Privacy Policy and Data Processing Addendum (DPA), constitute the complete agreement ("Agreement") between ChatBotBiz.AI ("we", "us") and you, the user ("Customer"). By registering or using our services, you acknowledge that you are authorized to bind your organization to this Agreement.
- Account & Use
You are responsible for maintaining accurate information in your account, keeping login credentials secure, and ensuring that all account activities comply with this Agreement. Only authorized users are permitted to access the account, which must be used for business purposes only.
- Confidentiality & Data
You own your data, but grant us permission to process it as needed to provide our services. All customer data is kept confidential and will not be accessed except to support your account, as required by law, or to ensure system security.
- Acceptable Use
Our services must not be used for illegal, harmful, or disruptive activities. Unauthorized access, reverse engineering, sharing login credentials, and actions that compromise the security or performance of the services are strictly prohibited.
- Third-Party Services
We may offer integrations with third-party applications, but we are not responsible for their performance or data handling. Please review the third-party terms before enabling any integration.
- Fees & Payment
Fees are payable in accordance with the rates on our website. Failure to pay may result in suspension or termination of services. Subscription renewals and billing cycles are specified at signup; refunds for unused time are not provided.
- Disclaimer of Warranties
Services are provided "as-is" and without guarantees. We do not warrant uninterrupted, error-free service and are not responsible for issues arising from third-party providers, customer hardware, or internet disruptions.
- Limitation of Liability
ChatBotBiz.AI's liability for any claim arising under this Agreement is limited to the fees paid by you in the preceding 2 months. We are not liable for indirect, incidental, or consequential damages.
- Arbitration Agreement
Any dispute arising out of or related to this Agreement will be settled by binding arbitration in Montgomery County, Maryland. By agreeing to these terms, both parties waive the right to a jury trial and consent to resolving disputes through arbitration.
- Final Provisions
If any provision is deemed unenforceable, it does not affect the remaining terms. This Agreement is governed by the laws of the State of Maryland, excluding conflicts of law principles.
